Freedom of Information Act (FOIA)
York Technical College is subject to the South Carolina Freedom of Information Act,
S.C. Code Ann. §30-4-10. Pursuant to section 30-4-30 (c), a response to a written FOIA request must be made within 10 days (weekends and holidays are excluded) of receipt of the written request. If the request is granted, then the documents have to be produced no later than 30 calendar days after the response date. If the documents requested are more than two years old, the response time is 20 days, and the documents must be produced no later than 35 calendar days from the response date.
To assist you in completing a FOIA Request, we have attached a FOIA Request form at the bottom of this page. Be sure to fill in all sections of the request. To ensure accuracy in York Technical College's response, we ask that requests are as descriptive as possible.
Exemptions and Redaction
York Technical College adheres to the Family Privacy Protection Act of 2002 which sets forth the standards for redactions and/or denial for commercial solicitation requests.
The determination is not required to include a final decision or express an opinion as to whether specific portions of the documents or information may be subject to redaction according to exemptions provided for by Section 30-4-40 or other state or federal laws.
York Technical College will make reasonable efforts to produce information at the lowest possible cost. Please read below for a summary of our costs.
- Copying costs will be charged at a rate of $0.10 per page, $0.25 per 11x17 page, and $10 for standard maps larger than 11x17
- CDs and DVDs will cost $5 per disc.
- Flash Drives will cost $10 each.
- The fee for the search, retrieval, and redaction of records is based on the hourly
salary of the lowest paid employee who, in the reasonable discretion of the custodian
of the records, has the necessary skill and training to perform the request.
- At this time, the above referenced hourly rate is $18 per hour, and employee time will be billed in 1/4 hour increments.
- The fee schedule may vary as salaries change.
If fees apply to your request, an advanced deposit may be requested. The deposit may be up to 25% of the total anticipated cost. Once York Technical College has received the deposit, the search, retrieval and redaction process will begin. The College has thirty (30) calendar days from the date the deposit is received to furnish the requested records or make them available for inspection or copying. If the records are more than two years old, the College has thirty-five (35) calendar days from the date the deposit is received to furnish the requested records or make them available for inspection or copying.
Pursuant to S.C. Code Ann. §30-4-30(A)(2), a public body is not required to create an electronic version of a public record when one does not exist to fulfill a records request. However, pursuant to S.C. Code Ann. §30-4-30(B), if records are not in electronic format and the public body agrees to produce them in electronic format, the public body may charge for the staff time required to transfer the documents to electronic format.
Pursuant to S.C. Code Ann. § 30-2-50, obtaining or using public records for commercial solicitation directed to any person in the State of South Carolina is prohibited and is punishable by a fine of up to $500 and imprisonment up to one year, or both.
